BURDEN OF PROOF REVERSED

A JUXTAPOSITION OF
MEDICAL AND LEGAL
IN CRIMINAL CONVICTIONS OF
"SHAKEN BABY SYNDROME".

Burden Of Proof Reversed is dedicated to identifying the systemic flaws
in the Australian Criminal Justice System through analysis of cases conducted during the implementation of SC CR3 Expert Evidence in Criminal Trials.
We have since conducted four years of extensive research in SHAKEN BABY SYNDROME / ABUSIVE HEAD TRAUMA both in Australian and abroad and believe the 2018, Murder Trial of Dwayne Justin Lindsay a "Shaken Baby" prosecution will highlight the need for a
Criminal Cases Review Commission in Australia.

MEDICAL

“When a baby with the triad or any part of it is bought to hospital for medical care we must have in place as standard a protocol for the complete and rigorous medical, family and social assessment of every case and look for all of the causes of the triad.
Getting it wrong at this initial stage means that parents are assumed to be guilty and have to prove their INNOCENCE which is a complete
reversal of the burden of proof of our legal system.
Getting it right at this stage means that we will identify the treatable causes of the triad and we can get on with treating them".

LEGAL

"Shaken Baby Syndrome" is a medical diagnosis with extreme legal consequences, um Ive called it actually a medical diagnosis of Murder. Thats because the diagnosis it self was thought to prove every element of the crime of murder or child abuse where the child lived despite the fact that it emanates from doctors it really is a legal issue."

"It really is about diagnosing child abuse It is about finding a cause in abuse, finding a perpetrator as apposed to any treatment that we tend to think of as associated with a diagnosis. It's a constellation of symptoms that doctors have said and sometimes continue to say can prove that a baby was abused and who abused the baby."
